BabyRelay Terms of Service

Please read these Terms of Service ("Terms") carefully before using the BabyRelay application ("the app", "Service"), operated by Voiyag LLC ("we", "us", "our").

1. Acceptance of Terms

By downloading, installing, or using BabyRelay, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the app. These Terms constitute a legally binding agreement between you and Voiyag LLC.

2. Description of Service

BabyRelay is a baby monitor application that enables real-time video and audio streaming between two devices over a local or internet network using WebRTC technology. The app is intended as a supplementary monitoring tool for infants and young children. Streams travel directly between devices whenever possible; on restricted networks, Base and Pro plans may route streams through an encrypted TURN relay. Streams are never stored on our servers.

3. Eligibility

• You must be at least 18 years of age to create an account and use this Service.
• By using the app, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
• If you are using the app on behalf of a household, you represent that you have authority to bind all users within your Family Sharing group to these Terms.

4. Important Safety Disclaimer

By using this app, you acknowledge and agree that:

• The app is a supplementary monitoring aid only and should never be the sole means of supervising a child.
• Network interruptions, device failures, battery depletion, or software errors may cause the monitoring connection to drop without warning.
• Sound and motion detection features use algorithmic approximation and may produce false positives or fail to detect events.
• Notification delivery depends on third-party push notification services (Apple APNs, Google FCM) and is not guaranteed.
• You are solely responsible for the safety and well-being of any child being monitored.
• We are not liable for any harm, injury, or loss resulting from reliance on this app for child supervision.

5. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to refuse registration or cancel accounts at our discretion.

6. Subscriptions & Payments

Free Tier

• Basic monitoring with one connected parent device.
• Sound and motion alerts.
• Local clip storage on device.

Paid Tiers (Base & Pro)

• Additional features as described on the subscription page within the app.
• Subscriptions are billed monthly or annually through the Apple App Store or Google Play Store.
• Payment is charged to your App Store or Play Store account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• The renewal charge will be the same as the initial subscription price unless we notify you of a price change.
• You can manage and cancel subscriptions through your device's App Store or Play Store settings.

Free Trials

• If offered, a free trial automatically converts to a paid subscription at the end of the trial period unless canceled at least 24 hours before the trial ends.
• Unused portions of a free trial are forfeited upon purchasing a subscription.

Refunds

• Refund requests are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies.
• We do not process refunds directly.

7. Device Permissions

The app requires access to certain device features to function:

• Camera — Required on the Baby Unit device to capture video for streaming.
• Microphone — Required on the Baby Unit to capture audio, and on the Parent Unit for two-way talk features.
• Push Notifications — Required on the Parent Unit to receive sound/motion alerts.
• Background Audio — Used to maintain monitoring when the app is not in the foreground.

You may revoke any permission through your device's settings, but doing so may impair or disable core functionality.

8. Network & Connectivity

• The Service requires an active internet connection on both devices.
• Connection quality depends on your local network conditions, internet service provider, and NAT configuration.
• Peer-to-peer connections may not be possible on all networks (e.g., symmetric NAT, restrictive firewalls). Paid tiers may offer relay (TURN) server support for such networks.
• We are not responsible for connectivity issues caused by your network infrastructure, ISP, or device limitations.
• Data usage varies based on video quality settings and may incur charges from your mobile carrier.

9. Acceptable Use

You agree NOT to:

• Use the app for any unlawful surveillance or monitoring purpose.
• Monitor any person without their knowledge and consent where legally required.
• Use the app to monitor anyone other than your own infant or young child, or a child for whom you are the legal guardian or authorized caregiver.
• Attempt to intercept, decrypt, or tamper with other users' streams or data.
• Reverse-engineer, decompile, or disassemble the app except as permitted by applicable law.
• Use the app to transmit malware, spam, or harmful content.
• Share your account credentials with unauthorized third parties.
• Circumvent or disable any security or access control features.
• Use the app in any way that violates applicable local, state, national, or international law.

10. Family Sharing

• Account holders may invite family members to access their baby unit as parent viewers.
• The account holder is responsible for ensuring all invited family members agree to these Terms.
• The account holder is responsible for managing shared access permissions.
• Shared access can be revoked at any time from the Devices screen.
• We are not responsible for actions taken by users you have granted shared access to.

11. User Content & Recordings

• Alert clips and recordings created through the app are your content.
• You are responsible for ensuring your use of recordings complies with applicable privacy and recording consent laws in your jurisdiction.
• For Pro subscribers, alert clips uploaded to cloud storage (Amazon S3) are automatically deleted after 30 days.
• We do not access, view, or use your recordings except as necessary to provide the Service or as required by law.

12. Intellectual Property

• BabyRelay, its logo, and all related content, features, and functionality are owned by Voiyag LLC and protected by copyright, trademark, and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial baby monitoring purposes.
• This license does not include the right to modify, distribute, sell, lease, or create derivative works from the app.

13. Privacy

Your use of BabyRelay is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the app, you consent to the practices described in the Privacy Policy. Key highlights:

• Streams go device-to-device when possible; on restricted networks, Base and Pro use an encrypted relay. Either way, never stored on our servers.
• Signaling data is automatically deleted after 1 hour.
• Alert records are automatically deleted after 7 days.
• You can delete your account and all associated data at any time.

14. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF SOUND/MOTION DETECTION.
• WARRANTIES REGARDING THE RELIABILITY OF PEER-TO-PEER CONNECTIONS OR NOTIFICATION DELIVERY.
• WARRANTIES THAT THE APP WILL BE COMPATIBLE WITH ALL DEVICES OR NETWORK CONFIGURATIONS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOIYAG LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• ANY LOSS OR DAMAGE ARISING FROM RELIANCE ON THE APP FOR CHILD SUPERVISION.
• ANY LOSS OF DATA, REVENUE, OR PROFITS.
• ANY DAMAGES ARISING FROM SERVICE INTERRUPTIONS, CONNECTION FAILURES, OR MISSED NOTIFICATIONS.
• DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless Voiyag LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the app.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.
• Content you create, store, or share through the app.

17. Service Availability

• We do not guarantee uninterrupted availability of the Service.
• We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice when practicable.
• Scheduled maintenance will be communicated in advance when possible.
• We are not liable for any modification, suspension, or discontinuation of the Service.

18. Termination

• You may terminate your account at any time by deleting it from Settings > Account > Delete Account, or via the web deletion page.
• We may suspend or terminate your account if you violate these Terms, with or without notice.
• Upon termination, your right to use the app ceases immediately and all associated data will be deleted in accordance with our data retention policies.
• Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

19. Dispute Resolution

• You agree to first attempt to resolve any dispute informally by contacting us at support@babyrelay.io. We will attempt to resolve the dispute within 30 days.
• If a dispute cannot be resolved informally, you agree that any legal action shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the jurisdiction of such courts.
• You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Voiyag LLC.

20. Third-Party Services

The app integrates with the following third-party services, each governed by their own terms:

• Apple App Store / Google Play Store — for app distribution and subscription billing.
• Amazon Web Services (AWS) — for authentication, database, and cloud storage.
• RevenueCat — for subscription management.
• Expo — for push notification delivery.

We are not responsible for the availability, terms, or practices of these third-party services.

21. Apple & Google App Store Terms

If you downloaded the app from the Apple App Store or Google Play Store, the following additional terms apply:

• These Terms are between you and Voiyag LLC, not with Apple Inc. or Google LLC.
• Apple and Google have no obligation to provide maintenance or support for the app.
• In the event of any failure of the app to conform to applicable warranties, you may notify Apple/Google for a refund of the purchase price (if any); beyond that, Apple/Google have no warranty obligation.
• Apple and Google are not responsible for addressing any claims relating to the app or your use of it.
• Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

22. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, power outages, or pandemics.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

24. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of the app after changes are posted constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the app and delete your account.

25. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

26. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voiyag LLC regarding your use of the Service, and supersede any prior agreements.

27. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
